AI Use, Content Provenance & Knowledge Work

This page is the canonical statement of what LiquidSMARTS℠ produces and sells, how we produce it, and what we warrant. It is referenced by our Terms of Service, our Privacy Policy, and the terms attached to every deliverable and engagement. Where another document disagrees with this one on AI use, content provenance, or our standard of performance, this page controls.
1. What We Produce and Sell
1.1 The Subject of the Sale
LiquidSMARTS℠ produces knowledge work. The commercial value of that work sits in three things, and a client purchases access to all three under license:
- Procedural knowledge structures. The repeatable sequences that convert commercial intent into commercial result: diagnostic sequences, qualification logic, call and meeting architectures, coaching protocols, assessment instruments, scoring rubrics, and the decision rules that govern when each is applied.
- Innovative knowledge structures. The original frameworks and models that organize a commercial problem so it can be solved, including the Commercial Engineering methodology, the COF (Clinical, Operational, Financial) outcomes framework, Pipeline Velocity metrics and formulas, Gain Game Science, and the Learning Lab system.
- Commercial artifacts. The instruments through which a client realizes value from the above: playbooks, participant manuals, facilitator guides, calculators, templates, dashboards, briefs, analyses, curricula, and configured tools.
1.2 Ownership
These knowledge structures are the proprietary intellectual property of GFW Management II LLC d/b/a LiquidSMARTS℠. They were developed through original research, direct client engagement, and sustained investment, and they exist independently of any single engagement. LiquidSMARTS℠ retains all right, title, and interest in them.
Ownership of a commercial artifact created specifically for a client passes to that client on full payment, as set out in the governing agreement. The knowledge structures embedded in that artifact remain ours and travel with it under license, never by transfer.
1.3 Human Authorship
Every LiquidSMARTS℠ knowledge structure and commercial artifact is the product of human authorship. Our team originates the substance, exercises the professional judgment, makes the selections, arranges the material, and accepts responsibility for the result.
Software is a tool of production. The use of AI described in Section 2 extends the speed and reach of that authorship. It does not displace it, does not transfer authorship to any tool or tool provider, and does not diminish the protectability of the work. A LiquidSMARTS℠ deliverable is a work of authorship in which the creative and analytical contributions are human, produced with computer assistance in the ordinary way that professional knowledge work has been produced with computer assistance for four decades.
1.4 Enforcement
LiquidSMARTS℠ defends this intellectual property. Unlicensed reproduction, redistribution, derivative use for external distribution, use to build or operate a competing offering, and removal or alteration of attribution or branding are each a material breach, and each is grounds for injunctive relief in addition to any other remedy.
LiquidSMARTS℠ is a service mark of GFW Management II LLC. LiquidSMARTS℠ is a services firm, and the service mark designation is the accurate one.
2. AI Use and Content Provenance
2.1 Standing Disclosure
LiquidSMARTS℠ uses artificial intelligence across the whole of its computer work. Research, drafting, analysis, synthesis, document production, code, correspondence, and quality review are all performed with AI assistance. This is how the firm operates, it is disclosed here in advance, and it applies to every engagement unless a written agreement says otherwise.
We use AI to extend capability. A small firm delivers the research depth, production volume, and turnaround of a much larger one because the computer work is amplified. The client benefit is the reason we do it, and the disclosure below is the price of doing it honestly.
2.2 Expect Provenance Markers
Every document, file, image, dataset, and digital artifact you receive from LiquidSMARTS℠ should be expected to carry AI content provenance markers.
LiquidSMARTS℠ has operated on Google Workspace since the firm's founding, and uses AI capabilities on that platform and others. Content produced or processed with generative AI tools may carry provenance signals applied by the producing platform. These include, without limitation:
- Embedded watermarks applied at generation, including Google SynthID and equivalent schemes from other providers
- Content Credentials and other C2PA provenance manifests
- File and document metadata recording tool, model, or platform of origin
- Statistical and stylistic signatures that automated AI-detection tools identify as machine-assisted
Assume markers are present. Treat their presence as expected and disclosed.
2.3 Markers Are Not a Defect
The presence of an AI content watermark, provenance manifest, metadata record, or detector signal in any LiquidSMARTS℠ deliverable is a disclosed characteristic of that deliverable. It is not a defect, a nonconformity, a deficiency, a breach of any warranty, or a ground for rejection, withholding of payment, or termination. Acceptance criteria in any Statement of Work are read subject to this section.
2.4 What AI-Detection Tools Actually Show
Automated AI-detection tools return probabilistic estimates. They carry documented false-positive rates, they disagree with one another on identical input, and they are known to flag human-written text, particularly structured professional and technical writing of the kind we produce.
No output of any AI-detection tool constitutes evidence of authorship, originality, quality, workmanlike performance, plagiarism, or misconduct in connection with LiquidSMARTS℠ work. Questions about a deliverable are resolved against the standard in Section 3 and the acceptance criteria in the governing agreement, which is the same standard that has always governed our work.
2.5 We Do Not Strip Provenance
LiquidSMARTS℠ makes no representation that provenance markers can be removed from any deliverable, and will decline any request to remove, defeat, obscure, or misrepresent them. Provenance data is a truthful record of how a thing was made. Removing it would misrepresent the work, and we will not do that on our own account or on a client's.
2.6 Client Data in AI Systems
Client confidential information is handled under the confidentiality terms of the governing agreement, and those terms apply in full to AI-assisted processing. LiquidSMARTS℠:
- Uses enterprise and business-tier AI services under terms that exclude customer content from provider model training
- Does not submit protected health information, personally identifiable information beyond ordinary business contact details, or client-designated restricted data to any AI service absent specific written instruction
- Applies the same confidentiality obligations to AI-assisted processing that apply to every other part of the engagement
2.7 Client Restrictions Must Be Stated in Advance
Where a client policy, regulatory obligation, or procurement term restricts or prohibits AI-assisted production, the client states that restriction in writing before work begins. LiquidSMARTS℠ will then confirm in writing whether it can meet the restriction and at what scope, timeline, and fee, because a restriction of this kind changes the economics of the engagement.
Absent a written restriction accepted by LiquidSMARTS℠ in advance, the disclosure in this section governs, and the client is deemed to have received it.
3. Workmanlike Validation
3.1 The Standard
LiquidSMARTS℠ warrants that its knowledge work is performed in a workmanlike manner, meaning with the care, skill, diligence, and professional judgment ordinarily exercised by qualified practitioners performing comparable commercial consulting and training work under comparable conditions. This is the standard that governs, and it is the standard against which any question about a deliverable is measured.
3.2 Human Validation
The workmanlike standard is satisfied by human validation, not by the tool that assisted production. Before any deliverable leaves LiquidSMARTS℠:
- A qualified human reviews it against the engagement's stated objectives and acceptance criteria
- Substantive claims, figures, citations, and recommendations are checked against their sources
- The deliverable is read in its final rendered form, as the recipient will receive it
- A named human at LiquidSMARTS℠ accepts responsibility for the result
Accountability for every deliverable rests with LiquidSMARTS℠ and with the human who released it.
3.3 Notice and Cure
If a client believes a deliverable fails the workmanlike standard, the client gives written notice within fifteen (15) days of delivery identifying the specific deficiency. LiquidSMARTS℠ will re-perform the deficient work at no additional charge. Re-performance is the client's exclusive remedy and the sole obligation of LiquidSMARTS℠ for a claim of deficient performance.
3.4 Outcomes Are Not Warranted
The workmanlike standard governs the performance of the work. It does not warrant a business outcome. Commercial results depend on client execution, market conditions, competitive behavior, and organizational factors outside our control. Except where a written agreement states a specific success fee or performance guarantee, no specific financial result, deal closure, or pipeline metric is guaranteed.
3.5 Relationship to Other Warranties
Except as stated in this section and in the governing agreement, LiquidSMARTS℠ disclaims all warranties, express or implied, including the implied warranties of merchantability and fitness for a particular purpose.
Governing Law and Contact
This policy is governed by the laws of the State of Tennessee, without regard to conflicts of law principles. Venue for any dispute is Hamilton County, Tennessee.
